These Terms of Service ("Terms") form a legally binding agreement between you ("you", "your", or "Customer") and LogicByte Studios ("LogicByte", "we", "us", or "our") regarding your access to and use of the Fliver product, websites, dashboards, plugins, gateways, APIs, documentation, and related services (collectively, the "Service").
By creating an account, creating a project, pairing a game server, accepting a responsibility checkbox, clicking accept, or otherwise accessing or using the Service, you agree to these Terms and to our Privacy Policy and Rules. If you do not agree, do not use the Service.
If you use the Service on behalf of an organization, you represent that you have authority to bind that organization, and "you" includes that organization.
1. Definitions
For clarity in these Terms:
- "Endpoint" means any public HTTP route exposed through Fliver (for example under {organization}.{domain}/v1/{project}/...) whose response is produced by your paired game server, scripts, plugins, or other systems you control.
- "Project" means a Fliver project you create under an organization or team, typically bound to one paired game server and one or more Endpoints.
- "Relay" means Fliver’s role of forwarding a public request to your paired server and returning the response you generate. Fliver does not author Endpoint payloads.
- "User Content" means any data, scripts, configuration, messages, JSON payloads, logs, names, images, or other materials you submit to or transmit through the Service, including Endpoint responses.
- "Dashboard" means the Fliver control-plane website used to manage accounts, teams, projects, sessions, billing, and settings.
2. Nature of the Service — Relay Platform
Fliver provides infrastructure that helps you expose data and actions from a game server (such as Minecraft) as public HTTP Endpoints without requiring inbound port forwarding on the game host. Public clients call Fliver; Fliver relays the request to your paired server over an outbound tunnel; your server (including your scripts) generates the response; Fliver returns that response to the public client.
Fliver does not create, edit, review, moderate, verify, endorse, or guarantee the truthfulness, legality, safety, or quality of Endpoint responses before they are delivered. Any disclaimer headers (for example X-Fliver-Disclaimer) are informational notices and do not change the fact that you are the content owner and publisher of Endpoint output.
You acknowledge that third parties may treat Endpoint responses as coming from a public URL on a Fliver domain. That does not make LogicByte the author of the payload. You remain solely responsible for what your Project serves.
3. Eligibility and Accounts
You must be able to form a binding contract under applicable law to use the Service. If you are under the age of digital consent in your jurisdiction, you may use the Service only with verifiable permission from a parent or legal guardian where required.
You must provide accurate account information and keep it updated. You are responsible for safeguarding credentials, session tokens, pair codes, API keys, and access to paired servers. You must promptly notify us of unauthorized access.
We may refuse registration, require verification, limit features, or suspend accounts where we reasonably believe there is fraud, abuse, legal risk, or Terms violations.
4. Projects, Pairing, and Responsibility Acceptance
Creating a Project may require you to expressly accept a responsibility statement confirming that you are solely responsible for content served through that Project’s public Endpoints, that Fliver only relays requests, and that you will not use Fliver for illegal or abusive purposes.
That acceptance is a material condition of using Project and Endpoint features. Bypassing, spoofing, or omitting required acceptance (including by API calls) is a breach of these Terms.
When you pair a game server, you authorize Fliver to establish a tunnel session, receive public requests destined for your Project, and return responses generated by your server. You must ensure only authorized operators can pair, regenerate codes, or revoke sessions.
5. User Content and Endpoint Responsibility
You retain ownership of your User Content to the extent you own it under applicable law. You grant LogicByte a limited, worldwide, non-exclusive license to host, transmit, cache, log (as described in the Privacy Policy), and otherwise process User Content solely to operate, secure, and improve the Service and to comply with law.
You represent and warrant that: (a) you have all rights necessary to publish and relay your User Content; (b) your User Content and Endpoints do not violate law, third-party rights, or these Terms and the Rules; (c) your Endpoints will not be used to harass, defraud, phish, distribute malware, dox, or facilitate unauthorized access to systems or personal data; and (d) you will not misrepresent Fliver as the author or endorser of Endpoint payloads.
You are solely responsible for: Endpoint design and authentication; script correctness; rate limits on your side; personal data you choose to expose; ban lists, player data, chat logs, or other sensitive material; and any dispute arising from third-party reliance on your Endpoint output.
If a third party brings a claim related to your Project, Endpoints, or User Content, you will defend and indemnify LogicByte as set out in Section 14, except to the extent a claim is finally determined to arise solely from LogicByte’s willful misconduct.
6. Acceptable Use
You must comply with the Fliver Rules and all applicable laws. Without limiting the Rules, you must not use the Service to:
- Violate criminal law, export controls, sanctions, child-protection laws, or intellectual-property rights.
- Distribute malware, ransomware, spyware, credential stealers, or exploit kits.
- Operate phishing, scam, social-engineering, or fraud schemes.
- Host or transmit child sexual abuse material or any sexual content involving minors.
- Conduct unauthorized scanning, intrusion, or attacks against third-party systems.
- Launder abuse through Fliver domains to evade enforcement elsewhere.
- Overload Fliver infrastructure or interfere with other customers’ use of the Service.
- Circumvent billing, quotas, authentication, suspension, or safety controls.
6.1 Enforcement
We may investigate suspected violations. We may remove, disable, throttle, quarantine, or permanently terminate Projects, Endpoints, tunnels, sessions, or accounts; preserve logs; and report to law enforcement or rights holders where appropriate. We are not obligated to monitor all traffic, but we may act on reports, automated signals, or legal process.
7. Service Availability, Beta Features, and Changes
The Service may be offered free, paid, or in beta. Features may change, degrade, or be discontinued. We do not guarantee uninterrupted or error-free operation, fixed latency, or permanent availability of any particular hostname, path, protocol version, or plugin build.
Beta or early-access features are provided as-is and may be unstable. You use them at your own risk.
We may update these Terms. Material changes will be indicated by updating the "lastUpdated" date in the published Terms document and, where practicable, by notice in the Dashboard or by email. Continued use after the effective date of changes constitutes acceptance, unless applicable law requires a different method.
8. Fees, Trials, and Taxes
Paid plans, add-ons, and purchase terms are described in pricing pages and any Purchase Policy we publish. Fees are generally non-refundable except where required by law or expressly stated otherwise.
You are responsible for applicable taxes. Payment processors (for example Lemon Squeezy or other providers we designate) may process charges under their own terms. Failure to pay may result in suspension or downgrade.
9. Intellectual Property
Fliver, including software, branding, documentation, and non-User Content, is owned by LogicByte or its licensors and is protected by intellectual-property laws. Except for the limited rights expressly granted to use the Service, no rights are transferred to you.
You may not reverse engineer, copy, or create derivative works of the Service except to the extent such restriction is prohibited by law. Feedback you provide may be used by LogicByte without obligation to you.
10. Third-Party Services and Links
The Service may interoperate with third-party platforms (game servers, authentication providers, payment processors, DNS/CDN providers, analytics, or messaging tools). Your use of third-party services is governed by their terms. LogicByte is not responsible for third-party acts, outages, or policies.
Public Endpoints may be consumed by arbitrary third parties on the internet. You control what you expose. We do not control how third parties store, republish, or misuse data you choose to make public.
11. Privacy
Our processing of personal data is described in the Privacy Policy. By using the Service, you acknowledge that policy. If you expose personal data through Endpoints, you are the controller of that publication decision and must have a lawful basis and notices as required by law.
12. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT THAT ENDPOINT RESPONSES ARE ACCURATE, LAWFUL, SAFE, OR FIT FOR ANY PURPOSE; THAT THE RELAY WILL BE SECURE AGAINST ALL ATTACKS; OR THAT THE SERVICE WILL MEET YOUR REQUIREMENTS.
Some jurisdictions do not allow certain disclaimers. In those jurisdictions, disclaimers apply to the fullest extent permitted.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LOGICBYTE AND ITS DIRECTORS, EMPLOYEES, CONTRACTORS, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS, WHETHER BASED IN CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF: (A) THE AMOUNTS YOU PAID TO LOGICBYTE FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY; OR (B) FIFTY US DOLLARS (USD $50) IF YOU HAVE NOT PAID ANY AMOUNTS.
THE LIMITATIONS IN THIS SECTION APPLY TO CLAIMS ARISING FROM USER CONTENT, ENDPOINT OUTPUT, RELAY BEHAVIOR, SUSPENSIONS, OR THIRD-PARTY ACTIONS, EXCEPT WHERE LIABILITY CANNOT BE LIMITED UNDER APPLICABLE LAW (INCLUDING LIABILITY FOR DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE WHERE SUCH LIMITATION IS PROHIBITED).
14. Indemnification
You will defend, indemnify, and hold harmless LogicByte and its affiliates, officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your User Content or Endpoints; (b) your use of the Service; (c) your breach of these Terms or the Rules; (d) your violation of law or third-party rights; or (e) disputes between you and players, end users, or other third parties who consume your Endpoints.
15. Suspension and Termination
You may stop using the Service and may delete Projects or close your account subject to product capabilities and legal retention requirements.
We may suspend or terminate access immediately if we reasonably believe you have violated these Terms or the Rules, pose a security or legal risk, fail to pay fees, or if required by law. We may also discontinue the Service or portions of it with notice where practicable.
Upon termination, your right to use the Service ceases. Provisions that by their nature should survive (including ownership, disclaimers, limitations, indemnity, and governing law) will survive.
16. Abuse, Copyright, and Legal Requests
If you believe a Fliver-hosted Project or Endpoint infringes your rights or violates law, contact abuse@fliver.net (or legal@fliver.net) with sufficient detail to locate the Project/Endpoint, a description of the issue, your contact information, and a good-faith statement of your claim. We may remove or disable access while investigating.
We may respond to valid legal process. Where legally permitted, we may notify the affected customer.
17. Export and Sanctions
You must not use the Service in violation of export control or sanctions laws. You represent that you are not prohibited from receiving the Service under applicable laws.
18. Governing Law and Dispute Resolution
These Terms are governed by the laws applicable to LogicByte Studios’s principal place of business, excluding conflict-of-law rules, unless mandatory consumer protection laws in your country of residence require otherwise.
Courts with jurisdiction over LogicByte’s principal place of business shall have exclusive jurisdiction over disputes, subject to mandatory consumer venue rights. Either party may seek interim injunctive relief in any court of competent jurisdiction to protect intellectual property or confidential information.
Before filing a formal claim (where legally allowed to require this), the parties will attempt good-faith informal resolution by contacting legal@fliver.net.
19. General
These Terms, together with the Privacy Policy, Rules, and any Purchase Policy or plan-specific terms, are the entire agreement regarding the Service and supersede prior agreements on the same subject.
If any provision is unenforceable, the remainder remains in effect. Failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
No agency, partnership, or employment relationship is created. Headings are for convenience only. Notices may be provided via the Dashboard, email, or by updating published legal documents.
